Man severely injured from close

A man is facing multiple charges following a weekend shooting that left another man with serious injuries to his right leg.

Police arrested 23-year-old Devyn C. Padilla on Aug. 26 following a shooting in the 500 block of Chavez Street. Padilla is accused of shooting the man in the leg with a shotgun at close range.

Las Vegas police responded to an alleyway between Chavez Street and South Pacific Avenue around 3:30 p.m. on Aug. 26 after receiving a 911 call about the shooting, according to an arrest affidavit filed this week in San Miguel Magistrate Court.

One man was taken to Alta Vista Regional Hospital to be treated for a “massive gunshot wound to his lower right leg, below the knee,” the affidavit stated. Police attempted to interview the man while he was in the emergency room, but he was in too much pain to speak to officers and he was transported to the University of New Mexico Hospital in Albuquerque for trauma care.

A witness reported seeing a “bald man” driving a “little black car” in the area, and told police that the driver was “a Padilla.” A different witness said that after hearing gunshots, they saw a black car leaving the area. A third person identified the shooter as Devyn Padilla, the affidavit stated.

Investigators with the Las Vegas Police Department determined that the shooting occurred in the alleyway and recovered a cellphone and a shotgun shell casing. Investigators also located bone fragments and other “biological” evidence from the alley.

Later that evening, an officer with New Mexico State Police responded to a home on US-84 south of Las Vegas after a man reported someone was sitting in a black car parked in his driveway.

As NMSP officers approached the black Kia in the driveway, Padilla got out of the car, ran from officers and jumped over a fence. Officers caught up to Padilla and arrested him, according to a separate affidavit filed this week in Magistrate Court.

Inside the car, officers located a shotgun, two shotgun shell casings and a box of unfired shotgun shells. Padilla appeared intoxicated, the affidavit stated, and smelled of alcohol.

NMSP arrested Padilla and charged him with misdemeanor aggravated DWI, criminal trespass resisting an officer and negligent use of a deadly weapon.

An LVPD investigator spoke to the man who was shot after he underwent a second surgery at UNMH. The description of the shooter and his vehicle provided to the investigator matched Padilla and the black Kia, and Padilla was charged with felony aggravated battery and a misdemeanor charge of negligent use of a deadly weapon.

During a Monday hearing, Judge Philip Leger set an unsecured $10,000 bond in the misdemeanor case. A preliminary hearing is scheduled for Nov. 11.

During a hearing on Tuesday in the felony aggravated battery case, Judge Leger set a $10,000 unsecured bond for Padilla and he was released from jail.

The judge also ordered that Padilla be on house arrest and issued an order barring Padilla from having contact with the witnesses or the man who was shot. A preliminary hearing in the case is scheduled for Oct. 5.
